Roxbury Town Board Meeting Approved Minutes - September 14, 2015

APPROVED MINUTES

September 14, 2015

The regular meeting of the Town Board was held September 14, 2015 at 7:30 pm at the Town Hall.  Present were: Supervisor Thomas S. Hynes, Councilmen Gene Cronk, Edward Raeder, Allen Hinkley and Carol Murray, Hwy. Supt. Stephen Schuman, Attorney Kevin Young and 2 residents.

The Minutes of the August 10th meeting were approved on motion of Gene Cronk second by Allen Hinkley.

Hwy. Supt. Stephen Schuman stated stone & oil has been completed for the year on 16 miles of road, crews are doing repairs & widening the top of West Settlemernt Rd., working dirt roads for winter, ditching roads for 2016 stone & oil, the water filter system has been installed at the garage and he would like to include a new Ford 550 truck for the 2016 budget.

Councilwoman Murray questioned Johnson Hollow Rd. being in very bad need of repairs and sides eroding in spots. The matter was discussed.  The Highway Supt. stated crews have been placing more stone and filling  in those areas but to fix it right would cost $200,000 +/- and no organization wants to fund it at this time.

A written Assessor  report was distributed to the Town Board.  Assessor Clerk Stephanie Seminara stated she has not received many calls regarding the school tax bills incorporating the new re-val figures, Assessor Breglio is back to work,  they are waiting to hear on a SCAR decision and have two Article 7 assessment cases in October.

Parks Clerk, Carolynn Faraci reported the Labor Day event was a success adding that the same is planned for next year but will also hold a pancake breakfast, discussed work that has been completed in the park and  stated more bad trees are to be removed.

A possible leak was excavated on Cronk Lane, however no problem was found.  A representative from Rural Water will be here tomorrow to help locate the problem.

An estimate of work for repairs to the Transfer Station concrete was received from B&B Construction in the amount of $9,800.  Repairs will require the station to be closed for a few days.  The Highway Dept. is expected to complete the welding portion of the work.

RESOLUTION #69-APPROVE B&B CONSTRUCTION ESTIMATE ON TRANSFER STATION REPAIRS

On motion of Allen Hinkley second by Gene Cronk the following resolution was offered and adopted:

“RESOLVED, the Town Board accepts the proposal of B&B Construction for repairs to the Transfer Station in the amount of $9,800.00; and

BE IT FURTHER RESOLVED, per the proposal, the Town Board approves the cost of a pump truck if needed at a cost of $950.00 per use.”

Councilman Raeder reported on several broken/cracked windows at the Civic Center.  The matter will be looked into further.

A NYSEG energy audit was conducted on the Town Hall where lighting would be switched over to LED at a cost of $2,290.43.  Through the program, the Town’s share would be $890.11.

RESOLUTION #70-APPROVE NYSEG ENERGY PROGRAM

On motion of Carol Murray second by Edward Raeder the following resolution was offered and adopted:

“RESOLVED, the Town Board approves the changes to lighting at the Town Hall through the NYSEG Energy Efficiency Program at a cost of $890.11.”

A proposal was received from Lamont Engineers, PC for preparing the design, bid specs and bid materials in the amount of $10,000.  Discussion took place on using Good Neighbor funds for some costs to upgrade the generator at the highway garage.

RESOLUTION #71-ACCEPT LAMONT ENGINEERING PROPOSAL FOR GENERATOR BID

On motion of Allen Hinkley second by Gene Cronk the following resolution was offered and adopted:

“RESOLVED, the Town Board accepts the proposal of Lamont Engineer, PC to prepare the design, specifications and bid documents for upgrading the generator at the highway garage at a cost of $10,000; and

BE IT FURTHER RESOLVED, the Town Board authorizes the use of $25,000 of Good Neighbor Funds to pay for costs associated with the generator and the engineering of same provided said use is approved by NYC DEP.”

A letter was received from Diana Santos requesting late fees be waived on her Roxbury Water account that resulted from a late payment of $.44 charged to her account on 8/3/15.  The matter was discussed by the Town Board.

On motion of Gene Cronk second by Edward Raeder the Town Board agreed the $.44 late fee charged for the Roxbury Water District  account #186 of Diana Santos was not to be credited.

A letter was received from Jay and Deborah Gula requesting to hook up their house, located at 60090 State Hwy 30, Grand Gorge, to the Grand Gorge Water District.  A stub had been installed when the water line had been run from Roxbury Water.

RESOLUTION #72 – APPROVE GULA HOOKUP TO GRAND GORGE WATER

On motion of Edward Raeder second by Carol Murray the following resolution was offered and adopted:

“WHEREAS, the Town Board has received a letter from Jay & Deborah Gula requesting permission to connect their house, Tax Map #91.-1-56.7,  located at 60090 State Hwy 30,  to the Grand Gorge Water line; and

WHEREAS, the property is outside of the Grand Gorge Water District; and

WHEREAS, a stub was installed on the water main when the line was run from Roxbury Water to Grand Gorge Water;

NOW, THEREFORE BE IT RESOLVED, the Town Board authorizes Jay & Deborah Gula to connect their house, Tax Map #91.-1-56.7,  located at 60090 State Hwy 30, to the Grand Gorge Water line at their own expense, a meter would be supplied by the water district and provided they execute a water connection agreement; and

BE IT FURTHER RESOLVED, once the lateral line is connected, the property will be added to the Grand Gorge Water District on the tax roll.”

An email was received from Fran DiGregorio on behalf of the owners of Stratton Falls Campsite, Anna & Stanislaw Duszak, questioning what could be done about the new owners of the Stratton Falls house property, which contains the falls, posting the property as No Trespassing.  The Town Board took no action on the matter because it is not Town business as it currently stands.

Budget Officer Carolynn Faraci discussed the Tax Freeze program which would allow for property owners to receive a small rebate check, much like the school tax rebate checks that were received.  The Nov. 2014 Local Law to override the tax levy limit would have to be rescinded and a tax plan would be required to be submitted to the State.

RESOLUTION #73 – RESOLUTION OF THE ROXBURY TOWN BOARD ACCEPTING PROPOSED LOCAL LAW TO RESCIND LOCAL LAW NO. 3 OF 2014 AND TO OVERRIDE THE TAX LEVY LIMIT FOR FISCAL YEAR 2016 AS ESTABLISHED IN GENERAL MUNICIPAL LAW §3-c AND SCHEDULING PUBLIC HEARING FOR SAME

On motion of Carol Murray second by Edward Raeder the following resolution was offered and adopted:

“WHEREAS, on June 24, 2011 the New York State Legislature enacted Chapter 97 of the NYS Laws of 2011, hereinafter referred to as the “General Municipal Law §3-c”;

WHEREAS, General Municipal Law §3-c expressly authorizes local governments to override the tax levy limit by the adoption of a local law approved by a vote of at least sixty percent (60%) of the total voting power of the governing body (in this case, the “Roxbury Town Board”) ;

WHEREAS, the Town’s Attorney has prepared a proposed Local Law to Rescind Local Law No. 3 of 2014 since the 2015 Budget was kept within the tax levy limit thereby insuring that the qualifying taxpayers of the Town of Roxbury receive their rebates from New York State and to Override the Tax Levy Limit for fiscal year 2016 as established in General Municipal Law §3-c; and

WHEREAS, the Town Board has reviewed and modified the proposed Local Law to Rescind Local Law No. 3 of 2014 and to Override the Tax Levy Limit for fiscal year 2016 as established in General Municipal law §3-c; and

NOW, THEREFORE, BE IT RESOLVED that the proposed law is ready for consideration by the Town Board; and

BE IT FURTHER RESOLVED that the Town Board shall will hold a public hearing for consideration of the Local Law to Rescind Local Law No. 3 of 2014 and to Override the Tax Levy Limit for fiscal year 2016 as established in General Municipal Law §3-c on October 12, 2015 at 7:15  pm at the Town Hall; and

BE IT FURTHER RESOLVED that the Town Clerk is hereby authorized and directed to publish notice of said hearing in the Catskill Mountain News, and to post copies of such notice in the manner provided by law.”

Notice to Bidders

NOTICE TO BIDDERS

1.     Sealed bids will be received by the Town of Roxbury, hereinafter referred to as the “Owner,” until 3:00 pm, Thursday, October 8th, 2015, at the Town Clerk’s Office, 53690 State Highway 30, Main Street, Roxbury, NY 12474, at which time said bids will be publicly opened and read aloud for:

Contract No. 1 – DPW Garage Generator

Contract No. 1 shall include all tools, labor, material and equipment necessary to:

Provide a new 80 KW diesel generator and automatic transfer switch to serve the existing DPW Garage and an existing radio antenna on-site; remove existing generator that serves the radio antenna; and provide wiring from the new generator to existing automatic transfer switch that feeds the radio antenna. Work also includes related site work for the new generator. Under base bid, owner shall retain the removed generator for future salvage.

Deductive Alternate No. 1.1 – Contractor salvage of existing generator.

2.     All bids must be made on the blank form of proposal included in bidding documents.

3.     A bidder may withdraw any proposal submitted prior to the hour set for the closing of the bids provided the request is signed in a manner identical with the proposal being withdrawn.

4.     The Owner will be responsible for payment in accordance with the terms of the contract when the work is completed.

5.     The Owner is exempt from New York State sales taxes on material, supplies, and equipment to be permanently incorporated in the Work.  Tax Exemption No. 15-6001121.  Said taxes shall not be included in the Bid.

6.     A complete set of Bidding and Contract Documents may be obtained from Lamont Engineers upon payment of a $50.00 deposit.  Full deposit refund for the returned set will be made provided that the complete set of Bidding and Contract Documents (Project Manual) is returned to Lamont Engineers, postage paid and in good condition within 30 days after Bid Opening.  Any sets returned after the 30-day period are non-refundable. Additional sets of Bidding and Contract Documents may be obtained upon payment of a $25.00 deposit for each set.  Deposits for additional sets will be returned less the actual cost of reproduction if the complete sets are returned in good condition within the 30-day period. Requests for delivered sets of Bidding and Contract Documents will be honored overnight upon receipt of a non-refundable fee of $25.00 per set for handling and delivery.

7.     The Town Board of the Town of Roxbury reserves the right to waive any informalities or irregularities in the bids received and to reject any or all bids without explanation.

8.     The existing DPW Garage site and facilities (52508 State Highway 30, Roxbury) will be open for review by bidders on Tuesday, September 29th, 2015 from 10:00AM-12:00 Noon. If bidders are unable to make this time, they may try to schedule an appointment with the Highway Superintendent Stephen Schuman (607 326-4222).

Copies of the proposed law shall be available at the time of the hearing and shall be available at times prior to and after the hearing at the Town Clerk’s Office during normal business hours for the purpose of inspection or procurement by interested persons.

The proposed Local Law to Rescind Local Law No. 3 of 2014 relating to Fiscal Year 2015 and to Override the Tax Levy Limit for Fiscal Year 2016 as established in General Municipal Law §3-c establishes the Roxbury Town Board’s intent to override the limit on the amount of real property taxes that may be levied by the Town of Roxbury during fiscal year 2016.

Emily Gray did not attend to present the mylar map of the property on Andrew Gray Rd. that is to be transferred to  Andrew McArdle. She had been informed by Chairman Farleigh that this map was necessary as well as a deep pit and perk test on the property.

New Business

Chairman Farleigh gave his notice  of intention to step down as the chairperson for the Town of Roxbury Planning Board as of Jan. 1, 2016, although he will remain a member of the board.  Dave Cowan and Phil Zorda were discussed as possible replacements as chairman of the planning board.

Richard Purchell presented Application for Subdivision of property on Caroll Hinkley Road into three separate lots, two of which have viable septic. Informed that he needs perk and deep pit tests. Property sits on both sides of Carol Hinkley Road. Mr. Prurchell requested information re: how to complete the paperwork.  Ag. 1 district. Told he needs to send certificate of filing notice of subdivision to adjoining properties. Mr. Farleigh gave Mr. Purchell the necessary information.  Tax map #221.-1-2. The request is for three lots sizes: 0.62, 80 and 150 acres. Perk test needed only on the lot having no current septic.

Frank and Cecilia Towers purchased tax # 200.2-12 adjacent to their current property, tax # 200.1.9.81 near the intersection of Meeker Hollow and Cold Spring Roads. They would like to get a boundary line adjustment to combine the two lots. They were given the proper forms to apply for the adjustment.

Old Business

Jerome Libatore brought in the completed application for a boundary line adjustment to combine 0.49 acres, tax map # 200-1-78 currently owned by Manhattan Country School to their current 19 acres, tax map # 200-80.1 on New Kingston Mountain Road. The application was numbered 2015-5.

Paperwork was received from NYC DEP requesting further information on septic and soil tests for the Roxbury as Stratton Falls.

Gray Subdivision

Andy McArdle, the purchaser of the 6 acre subdivided lot, presented a Mylar map of the 6 acre lot to be divided from the 42.1 acre Gray parcel. Mr. Farleigh agreed to waive the survey of the entire parcel. A waiver of deep pit and perc test was granted.  Mr. Cowan is familiar with the site.    Motion for waiver Cowan, Cole, all in favor. Application forms and payment of $50 were presented and receipts for mailing notice of public hearing to adjoining properties. Mr. McArdle was asked to present a completed SEQRA form at the next meeting of the Roxbury planning board and was told that the subdivision proposal must be presented to the County planning board because the property is in an agricultural district. Motion to approve the subdivision by Cowan, 2nd Zorda, all in favor.

Orter Subdivision

Rick Brooks, of Brooks and Brooks, representing Kurt Ortner re: Subdivision of Kurt Ortner; Two lots on Hardscrabble Road 133-2-12.  A 258.18 acre lot, which is on both sides of Hard Scrabble Rd. to be divided and is under contract to New York City/DEP. The remaining 15.18 acres with the Ortner home will remain the Ortner’s.  Receipts for mailings of notice of public hearing to neighbors were presented. Completed SEQRA for part one was reviewed.  Parts 2 and 3 completed by the Board.  Mr. Zorda made a motion of Negative Declaration for SEQRA. seconded by Mr. Cole, all in favor. Mr. Zorda moved toj approve the subdivision, seconded by Cole. All in favor.  Application must be presented to the county planning board due to Ag District inclusion.

Brannen Subdivision

Rob Allison, representing the Charles Brannen property: Tax Map #91.-1-70.21.   Mr. Allison presented the receipts for the mailing to adjoiners. The property to be subdivided into two parcels: Parcel A 6.08 acres and Parcel B 21.98 acres.  The 21.98 acre parcel is to be purchased by NYCDEP.  Receipts for mailings to adjoiners were presented.

The board discussed the need for a road access to the Brannen property. The question is whether the lot was a “buildable lots” and if the possibility of road access even exists. The board discussed that the cost of road access was prohibitive. Ms. Oliver read the Regulation provisions allowing a waiver.   The Board agreed that this parcel met a sufficient number of those requirements allowing a waiver. Application must be presented to the County due to its NYS Rt. 30 location.  Mr. Allison presented Sketch Plats on the Brannen property showing the proposed subdivision as well as the completed results of the deep pit and perk tests. The motion to approve was tabled pending the investigation into a waiver of road access.

Ortner Subdivision

A motion to waive the perk and deep pit tests due to the topography and size of the lot was proposed by Dave Cowan, seconded by Jean Stone, all in favor.

Following review of SEQRA form Part 1 and completion of Part 2 and 3 by the Board, a motion for a negative declaration was proposed by Phil Zorda seconded by Rob Cole, all in favor.

Phil Zorda made a motion to approve the Ortner subdivision pending approval by the County planning board because it is located in an agricultural district; second by Mr. Cole, all in favor. A check for $50 was presented, an additional $45 was paid site inspection $25 two lote $20.

Masserson Site Plan Review, Stratton Falls

Mr. Allison presented amended site plans, dated 5-5-2015 for the Roxbury at Stratton Falls. The site plan did receive approval from the Delaware County Planning Board accepted the recommendation of the Roxbury Planning Board. A motion to approve the site plan as amended for the Roxbury at Stratton Falls was proposed by Phil Zorda, second by Jean Stone, all in favor.

Ms. Oliver presented two Land Acquisition notices:

Roxbury #8885, no comments were made.

Roxbury #8831, no comments were made.

A discussion of the need for the Deep Pit, perc test requirement was initiated by the Chairman. NYS DOH has this requirement Statewide for and new construction.  The test is valid for 2 years with a possible extension of 18 months.  Costs are being incurred that are frequently wasted. Most property sales are to NYSDEP which prohibits buildings on their properties.  Mr. Allyson and Brooks both stated that it is common for a new purchaser to site their home at a site requiring a different Deep pit and perc test to determine septic type.  Mr. Brooks indicated his experience in other towns, with the exception of Grahamsville, have no such requirement for subdividing.  Grahamsville requires septic design in addition to Deep pit and perc tests.  Allyson indicated that a nearby town has a lot designation of Recreational.  These lots may not be built upon and are intended for camping, hunting, etc.

Motion to approve the minutes of the April meeting by Phil Zorda, second by Jean Stone, all in favor.

The board agreed to present Mr. Hinkley’s name as a new Board member to the Roxbury Planning Board.

Mr. Zambri told Chairman Farleigh that he will send a letter of resignation due to business reasons.  Prospective new members were discussed. There is a preference for another member from Grand Gorge.

Fireworks ablaze at Kirkside Park this Sunday!

With the unofficial close to summer on our doorstep, The Town of Roxbury in partnership with the MARK Project, Roxbury Arts Group, WIOX, GRBA, GRLC, RFD, The Roxbury Motel, MTC and area businesses proudly present Roxbury Revelry—a full day of family fun and excitement culminating in a grand fireworks display at dusk.

Whatever your fancies, Roxbury Revelry will offer all the agreeable pursuits of summer fun in the Catskills. With the long awaited return of the Roxbury Nine, the event opens with an afternoon of memorialization of the roots of America’s resilient pastime. At 1pm the Roxbury Nine will be armed with their familiar ferocity as they take the field against the Brooklyn Atlantics in a double header. Game one brings the rules and nuances of 1898 to the forefront as this barehanded overhand pitched contest allows for a heated and competitive match. Game two will roll back the clocks to 1864 for the more “gentleman’s” game of the early days of baseball.

In 2007, the first group of Roxbury Nine retirees—Mark Cammer, Jim Johnson, John Shepard, Vinny Snyder, Dave Cowan, and Tim Hynes were inducted into the Roxbury Nine Hall of Fame, and in between games, the remaining founders—Rich Ellsworth, Mike Hynes, Matt Walker, Andrew Walker, Chris Hynes, and John Fairbairn will join the ranks with a notable recognition of the beginning days of Vintage Baseball in Kirkside Park. Their Hall of Fame Shirts will be appropriately presented by Andrea Cammer, wife of the late Mark Cammer—one of the Nine’s most stoic and talented players ever to take the field in Kirkside Park.

Children’s games reminiscent of an old time country fair will keep the kid’s in full swing. Sack races, bean-bag tosses and yes—a corn eating contest. And for those history buffs, park director Carolyn Faraci will be leading walking tours of the hamlet at 2 and 4 pm. With the entire hamlet listed on the State and National Registers of Historic Places, these gentle strolls thought the village offer a plethora of material on architectural detail as well as the local lore surrounding some of Roxbury’s most prominent structures.

Meanwhile, great food will be available all day by the Roxbury Fire Department, Roxbury Seniors and Ate O Ate food truck providing a culinary adventure to accompany a cold beverage–especially the fine craft beer of Catskill Brewery. Plen air painters will dapple the lawns of Kirkside Park with the works available for sale at the day’s end. And a “selfie” station will be set up in the barns for whose who want to capture the day in bodacious fashion. You can also tap into Kirkside Park’s colorful collection of costumes and stroll the grounds of this magnificent historic site in 1890’s grace and style.

At 6pm, the Woodshed Profits take the stage on the Island in Kirkside Park and will  launch into what they call “power twang,” a mix of rock n’ roll, Americana boogie, and country. They come in peace, and a nicer bunch of Catskill country boys you’ll not meet, but make no mistake: Woodshed Prophets will rock you. Immediately following their music, appropriately enough, the skies will bloom with fireworks.  Pyro-Engineering will be responsible for the grand finale of this spectacular event, and MTC’s own Glen Faulkner is the technician choreographing the climatic end to the day’s event.  Roxbury Revelry was funded in part by the A. Roxbury Town Board Approved Meeting Minutes - August 10, 2015

A Public Hearing and regular meeting of the Town Board were held August 10, 2015 at 7:15 pm at the Grand Gorge Civic Center.  Present:  Supervisor Thomas S. Hynes, Councilmen Gene Cronk, Edward Raeder, Allen Hinkley and Carol Murray and six residents.  Absent: Highway Supt. Stephen Schuman, Assessor Robert Breglio and Attorney Kevin Young.

The Public Hearing was called to order at 7:15 pm where the notice was read.  The hearing was called for comments on proposed Local Law #2-2015 to revise the current dog licensing law.  No comments were heard in favor of or against the law.  The hearing closed at 7:17 pm.

The regular meeting was called to order at 7:30 pm.

Supervisor Hynes stated that Highway Supt. Schuman was absent due to a family medical issue, Assessor Breglio was absent due to a medical issue and Attorney Young was absent due to illness.

The Minutes of the July 13, 2015 meeting were approved on motion of Gene Cronk second by Allen Hinkley.

Kevin Hubbell was present to discuss his final project to obtain his Eagle Scout ranking.  He requested approval from the Town Board to paint all of the fire hydrants in the hamlet of Roxbury to attain his goal.

RESOLUTION #61-APPROVE EAGLE SCOUT PROJECT

On motion of Allen Hinkley second by Edward Raeder the following resolution was offered and adopted:

“RESOLVED, the Town Board authorizes Kevin Hubbell the task of painting all fire hydrants in the hamlet of Roxbury for the purpose of obtaining the rank of Eagle Scout.”

David Martin of the Grand Gorge Community Action Group (GGCAG) questioned base materials for the playground at the Civic Center, requested cutting back more of the shrubs around the field, requested being able to put a storage shed beside the Western Catskills Community Revitalization Corp. (WCCRC) shed to house their wreaths, flower barrels, etc. and stated the GGCAG will be holding a pancake breakfast on September 19th.  Supervisor Hynes has met with the Town insurance rep to discuss the playground issues where a sign must be erected reading “Adult Supervision Required” and the ground materials must be a certified material, the shrubs have already been cut back and the shed will require approval from WCCRC as it would be on their property.

Parks Clerk Carolynn Faraci stated the summer youth program workers time has been extended one week through August 27th, she commended the kids on their work and discussed completed and scheduled work, a complaint of stream work turned in to NYSDEC has been investigated by a DEC officer who found no issues.

Assessor Breglio’s written report showed no major issues, discussed a wrap up on the revaluation, Board of Assessment review wrap up on grievances and expected court dates for Small Claims and Article 7 petitions.  Assessor Clerk Stephanie added the Town has received the 2015 EQ Rate from the State showing it at 100%.  Mr. Breglio was wished a speedy recovery.

Supv. Hynes reported the water leak by the Park Lane Trailer Park has been repaired as well as the leak across from the Roxbury Country Store.

The Roxbury/Grand Gorge Water revised bylaws have been distributed to the Town Board for review.  No action was taken.

Highway Supt. Stephen Schuman provided the Town Board with a written report showing several roads having been stoned & oiled, final stone & oil is expected to be completed this week, weather stripping is being replaced on all overhead garage doors, the water filtration system will be installed soon and he requested the Town Board  accept the highest auction bids for the sale of the tractor with mower, air compressor and power washer.

Discussion took place on the repairs needed on the Transfer Station building and the proposal of Cammer Construction.

RESOLUTION #62-ACCEPT CAMMER CONSTRUCTION PROPOSAL

On motion of Gene Cronk second by Allen Hinkley the following resolution was offered and adopted:

“RESOLVED, the Town Board accepts the estimates for repairs at the transfer Station as follows: Cammer Construction, Inc. costs $4,750-$7,000 and Peter Steenland welding costs $6,000-$7,500; and

BE IT FURTHER RESOLVED, it is understood by the Town Board that said cost estimates shall be dependent upon opening the floor; and

BE IT FURTHER RESOLVED, some of the welding will be completed by Town Highway employees.”

Discussion took place on the letter received from Fred Hults regarding his water bill for the second quarter of 2015 where he used 100 gallons over the minimum 4000 gal/month in May causing a charge of more than the minimum $7.00.  The Water Clerk stated the meter readings that month were taken on May 5th instead of May 1st possibly causing the overage in usage.  The Water Clerk was not directed to credit the account, therefore the additional charge for water will remain.

A letter was received from Vicky Thomas resigning from the position of School Crossing Guard effective July 16, 2015.

On motion of Gene Cronk second by Allen Hinkley the Town Board regretfully accepted the resignation of Vicky Thomas as School Crossing Guard effective July 16, 2015.

RESOLUTION #65- RESOLUTION OF THE TOWN BOARD FOR THE TOWN OF ROXBURY  in the Matter of the Adoption of Local Law No. 2 of 2015 entitled “Amended Dog Licensing Law”

On motion of Carol Murray second by Allen Hinkley the following resolution was offered and adopted:

“WHEREAS, in accordance with Article 7 of the New York State Department of Agriculture and Markets requiring municipalities to adopt dog licensing laws; and

WHEREAS, the Town of Roxbury previously adopted Local Law No. 4 of 2010 entitled Town of Roxbury Dog Licensing Law that went into effect on January 1, 2011; and

WHEREAS, since the adoption of Local Law No. 4 of 2010, the Town Board has determined that there is the need for the imposition of an additional licensing fee when, during an enumeration conducted by the Town, an unlicensed dog is identified; and

WHEREAS, the proposed amendment was presented to the Town Board at least 11 days prior to the Town Board meeting on July 13, 2015; and

WHEREAS, the Town Board adopted a resolution on July 13, 2015 scheduling a public hearing on the proposed amended Law for August 10,  2015; and

WHEREAS, the public hearing on the proposed amended Dog Licensing Law was held on August 10, 2015 at the Grand Gorge Civic Center; and

WHEREAS, the Town Board reviewed and considered all public comments received on the proposed amended Law; and

WHEREAS, the proposed amended Law was on file for inspection at the Clerk’s office prior the hearing and during the public review process; and

NOW THEREFORE, BE IT RESOLVED AS FOLLOWS BY THE TOWN BOARD OF ROXBURY, DELAWARE COUNTY, NEW YORK:

The Town of Roxbury Amended Dog Licensing Law, being Local Law No. 2 of 2015, is hereby adopted and the Town Clerk is hereby directed to file said Local Law with the Office of the Secretary of State in accordance with State Law.”

WHEREUPON, the Resolution was put to a vote and recorded as follows:

RESOLUTION #66-SALE OF 1991 BRUSHCUTTER

On motion of Gene Cronk second by Edward Raeder the following resolution was offered and adopted:

“WHEREAS, the Town Highway Supt. was authorized to post the sale of the 1991 John Deere tractor with mower (brushcutter) on Auctions International; and

WHEREAS, the high bid was $13,600;

NOW, THEREFORE, BE IT RESOLVED, the Town Board authorizes the Highway Supt. to accept the high bid of $13,600 for the brushcutter.”

RESOLUTION #67-SALE OF PRESSURE WASHER & AIR COMPRESSOR

On motion of Allen Hinkley second by Gene Cronk the following resolution was offered and adopted:

“WHEREAS, the Town Highway Supt. was authorized to post the sale of the 1986 L&A Crusader 1 Steam High Pressure Washer and Baldor 5hp Electric Motor Air Compressor on Auctions International; and

WHEREAS, the high bids were $130.00 and $62.00 respectively;

NOW, THEREFORE, BE IT RESOLVED, the Town Board authorizes the Highway Supt. to accept the high bids of $130.00 for the Pressure washer and $62.00 for the Air Compressor.”

The Town Board again discussed upgrading the generator at the highway garage. Previously, it was to be advertised for bids but then the option of purchasing a used generator from the Mountainside DEP sewer plant was available.  However, now that generator is no longer available.

RESOLUTION #68-HIGHWAY GARAGE GENERATOR

On motion of Allen Hinkley second by Gene Cronk the following resolution was offered and adopted:

“RESOLVED, the Town Board approves advertising for bids on a new generator for the highway garage as soon as specifications are received.”

The Town Board again discussed the roof problems at the Civic Center.  Lamont Engineers, PC are to put together estimates to construct a slanted roof over the flat roof.  Repairs will be made for this year and grants are expected to be available to use on the new roof.

The Denver Sewer and Roxbury Sewer reconciliations for the year 2014 have been completed and approved by NYCDEP.

Supervisor Hynes stated Lamont Engineer’s will be closing their office on Main Street, Roxbury and plan to move to the Roxbury Sewer building.

The Personnel Committee was reminded to have 2016 salaries to the Budget Officer by September 11, 2015 for the Tentative Budget.

Budget Officer Carolynn Faraci discussed issues with the Property Tax Relief program.  To qualify, the Town would have had to rescind the local law overriding the tax levy limit adopted in November 2014. However, due to the delay in approving the 2015-2017 Highway contract, the law was not rescinded in the period of time required.  The Town Board was requested to keep this in mind for the 2016 budget.

It was stated that Rebecca Jones from Grand Gorge just completed her final project to obtain the Gold Award in Girl Scouts.  This award is the equivalent of Eagle Scout for boys.  Her program was a tribute to veterans and the military.  Rebecca was wished well in obtaining her goal.

Labor Day events in Kirkside Park on September 6th include a vintage baseball game, music, food, walking tour, kid’s tent and fireworks.  All are invited to attend.

This Labor Day weekend, Roxbury, NY’s historic Kirkside Park will resound with the excitement of a true Americana experience. In partnership with the MARK Project, Roxbury Arts Group, Roxbury Fire Department, GRLIC, WIOX, and the Greater Roxbury Business Association, the Town of Roxbury offers a full day of family fun. Roxbury Revelry will feature locally sourced food, walking tours, area artists, children’s games, a glorious fireworks display, music from the Woodshed Prophets, plus the triumphant return of vintage baseball. The 14-acre, exquisitely manicured park will be abuzz with community, friends, families, and fun, celebrating the unofficial close to the summer season, Catskills style. Admission is FREE.

The festivities begin at 1 PM with a baseball double header, when the Roxbury Nine – decked out in 19th century gear, and champing at the bit after a five-year hiatus – take the field against longtime rivals the Brooklyn Atlantics. The games will run through the afternoon. Rumor has it the Roxbury Nine veterans will fill their ranks with members of the Fleischmanns’ own Mountain Athletic Club.

Kirkside Park will resemble a rollicking, old-fashioned country fair, with sack races, a beanbag toss, and a corn-eating contest. Meanwhile, grown-ups can partake of fine craft beer from the local brewmeisters of Catskill Brewery. At 2 PM and 4 PM, Kirkside Park Director Carolyn Faraci will be leading walking tours through town, sharing fascinating historical details about the hamlet, which is listed in the National Registry of Historic Places. Throughout the day, plein air painters will capture the scenes on canvas and sell their work.

As the sun drops in the western sky, at 6 PM, Sidney, NY’s own Americana rockers the Woodshed Prophets will plug in and deliver two sets of exciting live music for all, inspiring barefoot dancing in the cool summer grass. Performances at 6 PM and 7:15 PM. Bring along a blanket or lawn seat, sit back, and enjoy.

At dusk (approximately 8:30 PM) the night sky will light up with a magnificent fireworks display, putting a colorful cap on the first annual Roxbury Revelry gathering, sure to be an ongoing tradition. MTC General Manager and Licensed Pyrotechnician Glen Faulkner and his team promise a memorable close to the season.
