LEGAL NOTICE FOR ANNUAL ELECTION OF THE ROXBURY FIRE DISTRICT
DECEMBER 9, 2014

NOTICE IS HEREBY GIVEN that the Annual Election of the Roxbury Fire District will take place on December 9, 2014 between the hours of 6:00 p.m. and 9:00 p.m. at the Roxbury Fire Hall located at 53613 State Highway 30, Roxbury NY 12474 in the Town of Roxbury, State of NY, for the purpose of electing one Commissioner for a 5 year term, commencing January 1, 2015 and ending December 31, 2019.

Only persons residing within the fire district and registered to vote with the Delaware County Board of Elections on or before November 17, 2014 shall be eligible to vote.

NOVEMBER 2014 ROXBURY LIBRARY ASSOCIATION TUESDAY FORUM PROGRAM

For the November 2014 Roxbury Library Association Tuesday Forum program, Longyear Gallery artists Nat Thomas and Susan Whittenburg will offer a collage workshop at 1:00 p.m. on Tuesday, November 11, 2014 at 1:00 p.m. at the Roxbury Library. Town Board Special Meeting Approved Minutes - October 22, 2014

APPROVED MINUTES

October 22, 2014

A Special Meeting of the Town Board was held October 22, 2014 at 7:00 pm at the Town Hall.  The meeting was called to hold a Budget Workshop and to discuss any other business that may come before the Board.  Present were: Supervisor Thomas S. Hynes, Councilmen Gene Cronk, Edward Raeder, Allen Hinkley and Carol Murray, Highway Supt. Stephen Schuman, Assessor Robert Breglio and 2 residents.

Assessor, Robert Breglio distributed to the Town Board and discussed his findings on other Delaware County Towns Aged Exemption values.  He still recommends going down to 5% on the sliding scale of incomes as it will help protect seniors with re-val assessments.  The Assessor did not look into other Towns specific Veterans Exemption values but stated there are some that do or don’t offer it and the County does not offer it.

RESOLUTION #53 – RESOLUTION OF THE ROXBURY TOWN BOARD ACCEPTING PROPOSED LOCAL LAW TO INCREASE INCOME LIMITS FOR PARTIAL TAX EXEMPTIONS FOR PERSONS 65 YEARS OF AGE OR OLDER AND SCHEDULING A PUBLIC HEARING FOR SAME

On motion of Gene Cronk second by Carol Murray the following resolution was offered and adopted:

“WHEREAS,  pursuant to the authority granted by Section 467 of the Real Property Tax Law of New York State, real property within the Town of Roxbury owned by one or more persons, each of whom is 65 years of age or over, or real property owned by a husband and wife or by siblings, one of whom is sixty-five years of age or over, shall be exempt from town tax levy according to the following schedule based on income of the owner or combined income of the owners of the property for the tax year immediately preceding the date of application:

“WHEREAS, the Town’s Attorney has prepared a proposed Local Law that modifies the June 9, 2008 resolution originally adopted by the Town Board of the Town of Roxbury to address partial tax exemptions for persons 65 years of age or older by the addition of three additional income brackets; and

WHEREAS, the Town Board has reviewed and modified the proposed Local Law; and

NOW, THEREFORE, BE IT RESOLVED that all previous resolutions in regard to “TAX EXEMPTIONS FOR PERSONS 65 YEARS OF AGE AND OLDER” are hereby rescinded and the following be adopted for granting tax exemptions for persons 65 and older in the Town of Roxbury; and

BE IT FURTHER RESOLVED, that the proposed law is ready for consideration by the Town Board; and

BE IT FURTHER RESOLVED, that the Town Board shall will hold a public hearing for consideration of the Local Law to modify the income limits for partial tax exemption for persons 65 years of age or older on November 6, 2014 at 6:30 pm at the Town Hall; and

BE IT FURTHER RESOLVED, that the Town Clerk is hereby authorized and directed to publish notice of said hearing in the Catskill Mountain News, and to post copies of such notice in the manner provided by law.”

WHEREUPON, the Resolution was put to a vote and recorded as follows:

RESOLUTION #54 – RESOLUTION OF THE ROXBURY TOWN BOARD ACCEPTING PROPOSED LOCAL LAW TO ADOPT THE NEW YORK STATE BASIC MAXIMUM VETERAN’S ALTERNATIVE EXEMPTION ON QUALIFYING RESIDENTIAL REAL PROPERTY AND SCHEDULING A PUBLIC HEARING FOR SAME

On motion of Allen Hinkley second by Gene Cronk the following resolution was offered and adopted:

“WHEREAS, pursuant to Title 2, Section 458-a of the Real Property Tax Law of New York State the Town Board of the Town of Roxbury has the authority to adopt the New York State Basic Maximum Veteran’s Alternative Exemption from taxation on the assessed value of qualifying residential real property; and

WHEREAS, pursuant to Title 2, Section 458-a the Town Board previously adopted Local Law No. 3 of the year 2003 which provided for a reduction of the New York State Basic Maximum Veteran’s Alternative Exemption to be employed by the Town of Roxbury; and

WHEREAS, at this time the Town Board has determined that it is necessary to provide additional relief to low income veterans in the community; and

WHEREAS, the Town’s Attorney has prepared a proposed Local Law that repeals Local Law No. 3 of 2003 and adopts New York State’s Basic Maximum Veteran’s Alternative Exemptions on qualifying residential real property; and

WHEREAS, the Town Board has reviewed and modified the proposed Local Law; and

NOW, THEREFORE, BE IT RESOLVED that Local Law No. 3 of 2003 be repealed and replaced with the proposed Local Law; and

BE IT FURTHER RESOLVED, that the proposed law is ready for consideration by the Town Board; and

BE IT FURTHER RESOLVED, that the Town Board shall hold a public hearing for consideration of the Proposed Local Law to adopt the New York State Maximum Veteran’s Alternative Exemption on qualifying residential real property on November 6, 2014 at 6:15 pm at the Town Hall; and

BE IT FURTHER RESOLVED, that the Town Clerk is hereby authorized and directed to publish notice of said hearing in the Catskill Mountain News, and to post copies of such notice in the manner provided by law.”

WHEREUPON, the Resolution was put to a vote and recorded as follows:

The Assessor will hold two public informational meetings on the status of the 2015 town-wide revaluation effort.  Said meetings shall be held Saturday November 1, 2014 at 1:00 pm at the Grand Gorge Civic Center and 3:00 pm at the Roxbury Town Hall.  Mr. Breglio  recommends the Town Board allow revaluations be completed every 4 years to keep up on current values.  Discussion took place on concerns raised with revaluation tax amounts and its effect on senior residents.

Carolynn Faraci, Budget Officer went over  2015 Tentative Budget with the Town Board and discussed the tax rates of each fund.  Regarding Tax Cap reporting, Mrs. Faraci stated there was a $5,500 carry over from last year, the Tentative Budget figures reflect being $48,000 under the tax cap amount allowed for 2015 and she has submitted the preliminary tax cap information to the State.  The Town Board discussed items in the budget specifically: the Roxbury Sewer budget has been amended and decreased from original figures, a new larger generator for the highway garage,  the Highway Supt. distributed the list of roads scheduled for repair in 2015 and discussed line items in the highway budget,   Councilman Cronk felt the Constable vehicle can go another year and requested the new vehicle be taken out of the 2015 budget, Councilman Hinkley stated he has learned there are grants available for a computer for the Constable car and requested keeping it in the budget and he again requested looking into electronic speed signs.  The Board directed the Budget Officer to make the following changes to the budget:  General Fund – add for a new generator for the highway garage and remove the Constable’s new vehicle.

RESOLUTION #55 – RESOLUTION TO GO INTO EXECUTIVE SESSION TO NEGOTIATE THE TERMS OF THE ROXBURY HIGHWAY ASSOCIATION COLLECTIVE BARGAINING CONTRACT

On motion of Allen Hinkley second by Gene Cronk the following resolution was offered and adopted:

“RESOLVED, the Town Board agrees to enter into Executive Session at 8:05 pm to discuss the terms of the Roxbury Highway Workers Association (RHWA) 2015/2016 collective bargaining contract.  Present were: Supervisor Thomas S. Hynes, Councilmen Allen Hinkley, Edward Raeder, Gene Cronk and Carol Murray.

The Town Board came out of Executive Session at 8:23 pm and on motion of Allen Hinkley second by Gene Cronk returned to the Special Meeting.  It was stated as a result of Executive Session, the Supervisor is to look into the arbitration process with the Delaware County Personnel Office and report back to the Town Board.

RESOLUTION #56 – PAYCHECK DIRECT DEPOSIT

On motion of Allen Hinkley second by Edward Raeder the following resolution was offered and adopted:

“RESOLVED, the Town Board will offer employees the option of direct deposit of paychecks effective January 1, 2015.”

            Notice is hereby given that the Preliminary Budget for the Town of Roxbury for the fiscal year 2015 has been completed and filed in the office of the Town Clerk where it is available for inspection during regular business hours.

Notice is further given that the Town Board will hold a Public Hearing on the Preliminary Budget at 7:00 pm on November 6, 2014 in the Town Hall at which time any person may be heard in favor of or against the proposed budget or any item therein.

Pursuant to Section 108 of the Town Law, the proposed salaries of elected officials are as follows:  Councilman (4) $4,668 ea., Justice (2) $7,931 ea., Supervisor $14,575, Tax Collector $9,533, Town Clerk $40,203, Highway Supt. $53,279.

Town Board Approved Minutes - October 13, 2014

APPROVED MINUTES

The regular meeting of the Town Board was held October 13, 2014 at 7:30 pm at the Town Hall. Present were: Supervisor Thomas S. Hynes, Councilmen Gene Cronk, Edward Raeder, Allen Hinkley and Carol Murray, Highway Supt. Stephen Schuman, Assessor Robert Breglio, Attorney Kevin Young and 5 residents.

On motion of Carol Murray second by Allen Hinkley the Town Board approved the Minutes of the September 8th Special and Regular meetings and the September 25th Special Meeting.

Assessor Robert Breglio provided the Town Board with a written report and updated them on the status of the re-val, discussed schedules of re-val assessment notices to residents, stated he will be holding informational meetings for the public regarding the re-val and requested increasing the income limits on both Aged and Veterans Exemptions. Attorney Young will research and prepare the paperwork for the exemptions for the October 22nd Special Meeting.

Highway Supt. Stephen Schuman stated he has begun getting sand & salt delivered, the last of the stone & oil roads have been completed, mowing and ditching continues weather permitting, stated the backhoe has been sent in for repairs and expressed concerns with the railroad crossing on County Hwy. 41.

Attorney Young discussed the NYC DEP Grand Gorge Sewer collection system assessment methodology. The Town is expected to apply for a Catskill Watershed Corp. program to pay for attorney fees. Mr. Young also discussed the County having passed a resolution where they will help Towns fight cases involving assessments of $500,000 or greater.

Attorney Young stated the truck case is expected to go to court.

On motion of Allen Hinkley second by Edward Raeder the Town Board approved the Town Clerk’s monthly report for September 2014 in the amount of $4,205.21 (Town Clerk $2,950.21 and Building Permits $1,255.00)

Sealed bids for Fuel Oil were advertised and opened on October 10, 2014 at 2:00 pm at the Town Hall. A total of three (3) bids were received and were as follows:

On motion of Gene Cronk second by Carol Murray the following resolution was offered and adopted:
“RESOLVED, the Town Board awards the Fuel Oil bid to Mirabito Energy at a fixed price of $2.8863/gal.”

No decision was made to fill the vacancy on the Historic Preservation Commission.

Discussion took place on renewing the health and dental insurance policies. Current policies are with Excellus BlueCross BlueShield (BCBS) for health and MVP Health Care for dental. Different coverage’s were discussed with the Town’s Insurance Coordinator. If renewing the current BCBS policy the benefits would remain the same for co pays, coverage’s, meds, etc. but the premium costs would decrease substantially from the current rates. If the current dental plan is renewed costs would only increase slightly.

RESOLUTION #48 – RENEW HEALTH & DENTAL PLANS
On motion of Allen Hinkley second by Edward Raeder the following resolution was offered and adopted:
“RESOLVED, the Town Board approves the renewal of the health insurance policy with Excellus BlueCross BlueShield’s SimplyBlue Plus Platinum 2 Plan; and
BE IT FURTHER RESOLVED, the Town Board approves the renewal of the dental insurance policy with MVP Health Care; and
BE IT FURTHER RESOLVED, said plans shall begin December 1, 2014.”

RESOLUTION #49 – RESOLUTION OF THE ROXBURY TOWN BOARD ACCEPTING PROPOSED LOCAL LAW TO OVERRIDE THE TAX LEVY LIMIT ESTABLISHED IN GENERAL MUNICIPAL LAW §3-c AND SCHEDULING PUBLIC HEARING FOR SAME
On motion of Allen Hinkley second by Gene Cronk the following resolution was offered and adopted:
“WHEREAS, on June 24, 2011 the New York State Legislature enacted Chapter 97 of the NYS Laws of 2011, hereinafter referred to as the “General Municipal Law §3-c”;

WHEREAS, General Municipal Law §3-c expressly authorizes local governments to override the tax levy limit by the adoption of a local law approved by a vote of at least sixty percent (60%) of the total voting power of the governing body (in this case, the “Roxbury Town Board”) ;
WHEREAS, the Town’s Attorney has prepared a proposed Local Law to Override the Tax Levy Limit Established in General Municipal Law §3-c; and
WHEREAS, the Town Board has reviewed and modified the proposed Local Law to Override the Tax Levy Limit Established in General Municipal law §3-c; and
NOW, THEREFORE, BE IT RESOLVED that the proposed law is ready for consideration by the Town Board; and
BE IT FURTHER RESOLVED, that the Town Board shall will hold a public hearing for consideration of the Local Law to Override the Tax Levy Limit Established in General Municipal Law §3-c on November 6, 2014 at 6:45 pm at the Town Hall; and
BE IT FURTHER RESOLVED, that the Town Clerk is hereby authorized and directed to publish notice of said hearing in the Catskill Mountain News, and to post copies of such notice in the manner provided by law.”

RESOLUTION #50 – RESOLUTION OF THE ROXBURY TOWN BOARD TO CONSIDER A LOCAL LAW FOR THE APPOINTMENT OF ALTERNATE MEMBERS TO THE TOWN OF ROXBURY PLANNING BOARD AND SCHEDULING A PUBLIC HEARING FOR SAME
On motion of Allen Hinkley second by Gene Cronk the following resolution was offered and adopted:
“WHEREAS, the Town of Roxbury Town Board would like to consider the appointment of alternate members to the Town of Roxbury Planning Board, as it is sometimes difficult to maintain a quorum on the Planning Board, due to illness, extended vacation or conflict of interest situations on a specific matter;
WHEREAS, in such instances, official business cannot be conducted delaying or impeding adherence to required timeliness;
WHEREAS, the use of alternate members in such instances would be beneficial to the Town residents;
WHEREAS, the Town Board Members and the Town’s Attorney have reviewed a proposed draft Local Law for the appointment of alternate members to the Town of Roxbury Planning Board;
NOW, THEREFORE, BE IT RESOLVED that the Town Board accepts the proposed draft Local Law; and
BE IT FURTHER RESOLVED, that a copy of the proposed draft Local Law shall be placed in the Town Clerk’s office and made available for public inspection; and
BE IT FURTHER RESOLVED, that the Town Board will hold a public hearing for consideration of the Local Law on November 6, 2014 at 6:50 pm at the Town Hall; and
BE IT FURTHER RESOLVED, that the Town Clerk is hereby authorized and directed to publish notice of said hearing in the Catskill Mountain News, and to post copies of such notice in the manner provided by law.”

RESOLUTION #52 – SEWER ADMINISTRATIVE SERVICE AGREEMENTS
On motion of Carol Murray second by Allen Hinkley the following resolution was adopted:
“RESOLVED, the Town Board approves Administrative Service Agreements with Diane Pickett for administration of Denver and Roxbury Sewer funds for reporting to NYCDEP; and
BE IT FURTHER RESOLVED, payment for services shall be paid by payroll and shall commence with the year 2014 in the amount of $1,500/year Roxbury Sewer and $500/year Denver Sewer.”

Town Board Approved Minutes - September 8, 2014

September 8, 2014

A Special Meeting of the Town Board was held September 8, 2014 at 4:30 pm at the Town Hall.  The meeting was called to discuss 2015 salaries and highway contract.  Present were: Supervisor Thomas S. Hynes, Councilmen Edward Raeder, Gene Cronk and Allen Hinkley, Highway Supt. Stephen Schuman, Attorney Kevin Young, Justice Wayne Pebler, Tax Collector Joan Moore and employees: David Thorington, Larry Shultis, Corbin Bouton, William Sprague, Ralph Sprague, Carolynn Faraci, Stephanie Seminara and Stephen Williamson.  Absent: Councilwoman Carol Murray.  No one from the public was in attendance.

Councilman Allen Hinkley stated the meeting was only supposed to be to meet with and discuss highway contract issues and not to discuss salaries of non-highway personnel.  Hinkley added the Personnel Committee’s (Councilman Hinkley and Murray) intentions are to stagger annual raises between highway and non-highway personnel to cut down on costs.

RESOLUTION #38 – RESOLUTION TO GO INTO EXECUTIVE SESSION TO NEGOTIATE WITH THE UNION FOR THE HIGHWAY WORKERS THE TERMS OF THEIR COLLECTIVE BARGAINING CONTRACT

On motion of Allen Hinkley second by Edward Raeder the following resolution was offered and adopted:

“RESOLVED, the Town Board agrees to enter into Executive Session at 4:45 pm to negotiate with the Roxbury Highway Workers Association (RHWA) on their 2015/2016 collective bargaining contract.  Present were: Supervisor Thomas S. Hynes, Councilmen Allen Hinkley, Edward Raeder and Gene Cronk, RHWA members William Sprague, Ralph Sprague, David Thorington, Larry Shultis and Corbin Bouton and Attorney Kevin Young.”

Non-highway salaries were discussed.  The Personnel Committee offered meeting individually if desired.

The regular monthly meeting of the Town Board was called to order at 7:30 pm.  Present were: Supervisor Thomas S. Hynes, Councilmen Gene Cronk, Edward Raeder, Allen Hinkley and Carol Murray, Highway Supt. Stephen Schuman, Assessor Robert Breglio, Building Inspector William Walcutt, Attorney Kevin Young and 6 residents.

The Minutes of the August 11, 2014 meeting were approved on motion of Carol Murray second by Allen Hinkley.

Robert Alison of Catskill Region Surveying Service and Kristin Janke Schneider of the Delaware County Planning Dept. discussed the draft flood maps that are currently being reviewed and commented on.  Unlike the current maps, the draft maps show flood areas per a detailed study of properties for the base flood.  Elevation certificates and LOMA’s were discussed and how they pertain to getting properties out of the mapped flood area and the effect on flood insurance costs. Assessor Robert Breglio questioned using the property owner survey his department compiled to help owners with getting them out of the mapped flood area, but it was stated the homeowner would still have to incur the costs for an elevation certificate to prove out of the flood zone.  It was also stated the Town cannot coordinate with one surveyor on behalf of the property owners for the purpose of them getting a lower rate to do an elevation certificate.  The Town must adopt the final maps and adoption is expected in 2015.

Assessor Robert Breglio stated 90% of the re-val data collection has been completed.  Letters are expected to be sent to owners in October or November to confirm what was found.  Any new assessment figures based on the re-val will be sent out in 2015.  State Real Property personnel will be here tomorrow to discuss the next steps and there are still problems being able to have complete access to the data files to complete all changes.

Highway Supt. Stephen Schuman stated salt prices are expected to increase 27% so he has begun to stockpile now before the increase goes into effect and crews are working dirt roads, ditching and replacing culverts before winter.

RESOLUTION #39 – RESOLUTION BY THE TOWN BOARD IN RELATION TO CONTROL OF SNOW ON COUNTY HIGHWAYS SECTION 135-A OF THE HIGHWAY LAW

On motion of Edward Raeder second by Gene Cronk the following resolution was offered and adopted:

“RESOLVED: That in pursuance of Section 135-a of the Highway Law, the Town Board of the Town of Roxbury hereby approves a certain agreement executed by the Town Superintendent of Highways of the Town of Roxbury with the County Superintendent of Highways of Delaware County for the performance by the Town of Roxbury for the work of control of snow on the County Roads within the boundaries of the County, upon the terms, rules and regulations as are contained in copy of such agreement that is annexed hereto and made a part hereof.”

William Walcutt, Building Inspector, questioned issuance of the Darrell Slater permit, has sent a letter to Caroline Lilly condemning her structures where the Historic Commission has told him that all buildings should be torn down and stated the Assessor’s office has requested him to add “cabin” to the building permit fee schedule (has been used as shed).  The Town Board directed the building inspector to issue the permit to Slater without Historic Preservation Commission (HPC) approval of work and Atty. Young will write a letter to HPC, said “no” to adding “cabin” to the permit fee schedule and the condemned notice to Lilly must be sent certified.

Discussion took place on the request of Roxbury Central School to hook up to water and sewer at the bus garage.

RESOLUTION #40 -RESOLUTION OF THE TOWN BOARD OF THE TOWN OF ROXBURY CONSENTING TO ALLOW THE ROXBURY CENTRAL SCHOOL DISTRICT BUS GARAGE TO CONNECT TO THE GRAND GORGE WATER DISTRICT

On motion of Allen Hinkley second by Edward Raeder the following resolution was offered and adopted:

“WHEREAS, the Town of Roxbury adopted its existing “Water use Law” (“SUL”) in November of 2012; and

WHEREAS, Section 21of the Town of Roxbury’s Water Supply Law addresses the Town’s requirements with regard to furnishing water to users outside of the Water District; and

WHEREAS, the Town Board has received and reviewed an acceptable Letter Request dated June 2, 2014 for permission for the Roxbury Central School District  (the “School District”) Bus Garage to Connect to the Town’s Water System; and

WHEREAS, according to the Town of Roxbury’s Water Supply Law the Bus Garage could connect to the water main pursuant to an out-of-district contract with the Grand Gorge Water District; and

WHEREAS, the School District will be responsible for all costs associated with the water connection including the cost of installing a lateral, a pressure reducing valve, and any other equipment required for the connection; and

WHEREAS, the water lateral would have to be designed by a licensed professional engineer and submitted to the Town Board for approval; and

WHEREAS, the School District would be responsible for obtaining any and all permits required for the installation of the lateral including approval from the New York State Department of Transportation to construct the water main under New York State Route 30; and

WHEREAS, the School District agrees to continue its use of its well water for non-potable purposes; and

WHEREAS, the School District will have to comply with the Town’s Water Supply Local Law and will have to reimburse the Town for all out-of-pocket expenses associated with the requested water connection; and

WHEREAS, the School District will be charged by the Grand Gorge Water District with the current water rate structure for system users and the Town of Roxbury has determined that it will not impose any connection fee upon the School District; and

THEREFORE, NOW BE IT RESOLVED THAT:

1.         The Town Board of the Town of Roxbury has evaluated the Letter requesting connection of the Roxbury Central School District’s Bus Garage to the Town of Roxbury’s Water District and hereby gives its consent to the School District to make the requested connection; and

2.         The Town Board requires that the School District contract with a Professional Engineer for the design of the water lateral that includes a pressure reducing valve and any other equipment required for the connection at its own expense; and

3.         The Town Board hereby gives its consent for the School District to connect to the Grand Gorge Water District pursuant to the Town’s Water Supply Law and waives the imposition of any connection fee.

A letter was received from Lewis Wendell requesting a “PARKING” sign be erected at the Town parking lot beside the old health building on Main St. Roxbury.  The matter will be looked into.

Councilman Raeder expressed concerns with people driving on the Civic Center ballfield to get to the playground at the back of the field.  The Town Board approved erecting a sign on the ballfield.

A letter was received from Michael Finberg, Reliable Tent Rental Co., complimenting Carolynn Faraci, Parks Clerk, for her professionalism and dedication in her duties in the park.

Councilman Allen Hinkley requested lighting be installed at Kirkside Park bridges for safety purposes.

For repairs of water and sewer lines in the State road right-of-way, the Town must apply for a Highway Work Permit each year.  The Town’s current umbrella portion is $4M.  NYS DOT is now requiring it to have a $5M minimum.  The insurance company will be contacted to increase the amount.

The Town Board discussed the Assessor’s request to adopt the Uniform Assessment Standards.  Attorney Young advises against the adoption of said standards.

The Town Planning Board has requested Jill Ribich to be appointed secretary since no one else on the Board would like to do it and also requested appointing Ribich and another person as alternate members to serve when other members go away through the winter.

RESOLUTION #42 – ALTERNATE PLANNING BOARD MEMBERS

On motion of Allen Hinkley second by Gene Cronk the following resolution was offered and adopted:

“RESOLVED, the Town Board approves appointing alternate Planning Board Members to serve during the absence of regular members; and

BE IT FURTHER RESOLVED, said approval is contingent upon the review of Attorney Kevin Young as to the legality of the matter.”

Discussion took place on the Assessor finding structures built without a permit, reporting it to the Building Inspector and no action taken.  Councilman Hinkley will speak the Building Inspector regarding the matter.

Supervisor Hynes reports that he has spoken with Martin Menne regarding his water charges and no further action will be taken by the Board at this time.

The Clean Sweep Program for hazardous materials will be held Sept. 19th & 20th and requires registration by Sept. 12th.

NOTICE IS HEREBY GIVEN that a public hearing will be held before the Town Board for the Town of Roxbury at the Roxbury Town Hall on the  6th day of November 2014, at 6:45 p.m., regarding the adoption of a Local Law to Override the Tax Levy Limit established in General Municipal Law §3-c.   This law is being proposed to comply with subdivision 5 of the General Municipal Law §3-c which expressly authorizes the Town Board to override the tax levy limit by the adoption of a local law approved by vote of at least sixty percent (60%) of the Town Board.  At such time and place all persons interested in the subject matter thereof will be heard concerning the same.

Copies of the proposed law shall be available at the time of the hearing and shall be available at times prior to and after the hearing at the Town Clerk’s Office during normal business hours for the purpose of inspection or procurement by interested persons.

The proposed Local Law to Override the Tax Levy Limit Established in General Municipal Law §3-c establishes the Roxbury Town Board’s intent to override the limit on the amount of real property taxes that may be levied by the Town of Roxbury.

A Call for Volunteers

Friday, October 24 and Saturday, October 25 from 4:30 pm to 8:30 pm

The Roxbury Arts Group is very happy to announce that the Haunted House will indeed be back again in Stamford for this Halloween season.  “We are very happy to have the opportunity to construct the Haunted House again in Stamford” said Jenny Rosenzweig, Executive Director of the Roxbury Arts Group.  Rosenzweig added, “the clock was ticking down as we looked to find a venue that could accommodate the Haunted House and The Catskill Watershed Corporation came through and saved the day by offering the Delaware Inn!”

Time is of the essence now to create the Haunted House.  A call is out for all volunteers who can help to please contact Maggie Cullen at 607.326.7908 or mcullen@roxburyartsgroup.org. Cullen added, “we can use all kinds of help in construction of the Haunted House, as well as actors, make-up artists and gate-keepers.  The Haunted House will be open Friday, October 25 and Saturday, October 26 from 4:30 pm to 8:30 pm.  There will be a nominal fee.  The Haunted House is not for young children, nor the feint of heart.  Enter if you dare.

LEGAL NOTICE OF PUBLIC HEARING ON 2015 BUDGET

NOTICE IS HEREBY GIVEN that the Proposed Budget of the Grand Gorge Fire District of the Town of Roxbury, State of New York, will be presented to the Board of Fire Commissioners of the Grand Gorge Fire District, for its consideration.

A PUBLIC HEARING will be held from 6:00 p.m. to 7:30 p.m. at the Grand Gorge Fire Hall, 60753 St. Hwy 30, Grand Gorge NY  12434, in the Town of Grand Gorge, State of New York on the 22nd day of October, 2014.

Pursuant to Town Law 105, the Board of Fire Commissioners must hold a public hearing on the budget, make the proposed budget available to the public prior to the public hearing, allow the public to comment on the budget at the public hearing.  This public hearing must be held to allow maximum public participation in the hearing.

The purpose of the public hearing is to allow any person to be heard in favor of or against the proposed budget as it is submitted, or for or against any item or items contained in the proposed budget, and hearing all persons interested in the subject  concerning same.

That a copy of the proposed budget is available at the Office of the Town Clerk of the Town of Roxbury at Main Street, Roxbury NY 12474 and Fire District Secretary at 60753 St. Hwy 30, Grand Gorge NY  12434 where it may be inspected by any interested person during office hours.

OCTOBER 2014 ROXBURY LIBRARY ASSOCIATION TUESDAY FORUM ON A WEDNESDAY

For the October 2014 Roxbury Library Association Tuesday Forum program, the RLA will offer a tour of the New York Power Authority’s Lansing Manor at 1:00 p.m. on Wednesday, October 8, 2014. RLA Tuesday Forum Coordinator Julia A. Menne cordially requests that all RLA Tuesday Forum attendees meet in the Roxbury Library parking lot at 12:30 p.m. for carpool transport to Lansing Manor.

The Roxbury Library Association welcomes the public to all RLA Tuesday Forum programs, activities, and gatherings, which are free of charge.

The Board of Fire Commissioners of the Roxbury Fire District will hold a public hearing on Tuesday 10/21/14 at 7:00 p.m. at the Roxbury Fire House located at 53613 State Highway 30, Roxbury NY 12474 on the proposed 2015 District Budget.  Copies of the proposed budget are available for inspection during regular office hours at the Office of the Town Clerk.

In addition, the Commissioners will hold their regular October meeting on 10/21/14, immediately following the hearing, to act on the budget and to discuss and act on district business.

A ‘First’ for the 21 year old Folk Art Music Festival FIDDLERS! 21

Columbus Day Weekend Sunday, October 12, 2014  •  Noon to 7pm

FIDDLERS! is 21 years old this year!  An entire day of fiddlin’ music, square dancing and this year for the first time, Shape-Note Singing led by ethnomusicologist and founder of what is currently the worlds’ largest Sacred  Harp singing convention, Tim Eriksen.  When talking about Eriksen, Josh Jackson from Paste Magazine said “no one has done more to help revive Sacred Harp singing among a younger generation.”  Along with performing with The Trio de Pumpkintown, Eriksen will lead a session in Shape Note singing, or Sacred Harp singing (as it is also known as), at Fiddlers! 21 on Columbus Day Weekend Sunday, October 12, 2014 from Noon to 7:00 pm.  The entire event will be held at the Roxbury Arts Center at 5025 Vega Mountain Road, Roxbury, NY, 12093.  Festivities include shape-note singing, square dancing, and performances by The Tremperskill Boys, Ryan McGiver with Stephanie Coleman & Cleek Schrey, Tim Eriksen and The Trio de Pumpkintown, and Special Guest Hilt Kelly.  Audience members are encouraged to bring their instruments to join the performers in the All-Star Jam!
